Restrict the Use of Radio telemetry in Washington State

Just received my Washington Department of Fish and Wildlife Commission Preliminary Agenda for March 7-8. As I was reading the Agenda, I came across Friday, March 7th 2:35pm 9. HUNTING EQUIPMENT RESTRICTIONS-RULE BRIEFING & PUBLIC HEARING. It went on to read, Department staff will brief the Commission on proposed amendments to WAC 232-12-045, Hunting equipment restrictions, which could restrict the use of radio telemetry equipment for hunting. The Commission will consider adoption of these amendments at its April 11-12, 2008 meeting in Pasco. Staff Report: Dave Ware, Game Division Manager, Wildlife Program. Does anyone know any details on this topic?

Below is the Law they are refering too.... Did the commission Agenda specifically have the works Tracking collar or telementry collar?? I'll have to look and read the commission notes..
WAC 232-12-045 Washington State Register filings since 2003
Hunting equipment restrictions.
It is unlawful to hunt deer or elk with the aid of infrared night vision equipment or with laser sights (not to include range finders) capable of projecting a beam onto the target, while in possession or control of a firearm, bow and arrow, or crossbow.

I don't know anything about it as I don't live there, but if I did I would make sure there are some hounddoggers at the meeting. Cause you can be damn sure there will be some animal rights culls there to voice their interests!

I just looked at my commission agenda..Hmmm.. You have a typo.. It doesn't say "could".. it says "would restrict the use of radio telementry equipment for hunting"..
Does anyone have the proposal?? I called but it was after hours..
Not sure it's relating to Hounds or not..

If that is the case, what a crock of shit.
People just don't get it, telemetry is way more for the safety of the hounds than it is an aid to take game. In this day and age with the yahoos that are around, you absolutely need to keep on top of the location of your dogs. If they are running or not.
In our area the days of leaving a dog out to find it's way home/out are long gone, cause that dog has a good chance of being scooped up.

Here is the Green sheet.. It looks like it concerns tracking wildlife collars for hunting..
The only Portion I worry about is that my truck is almost always equipted with telementry gear, I have a backup that never leaves my truck. So technically Any time I"m hunting deer or elk It could be illeagal.
I think we should probably look seriously at this.
Possession of radio-telemetry receivers while hunting
deer, elk, bear, moose, mountain goat, and bighorn sheep is
unlawful.
Most any SCANNER, or (I don't know) but even some HAM or 2 METER Radio's could be considered telementry recievers....

Secondly.....
food for thought..
I put a tracking collar on my wife (and will do so for my kids) or someone who is not familar with that woods while hunting... And I take my telementary equipment with me, that way I know, If something goes wrong I can find them.....
I think we should hit this possesion rule very hard it can affect all Hound guys, and we would be a target just for having our anntenna on our trucks..

It sounds like their trying to keep some fokes from tracking "Their Collared Wildlife" W.Va uses something around 225-228 Frq. For their Bear.. And Well their are some the Run these Bear..
Their's Always Some Jurks that have to have an Edge !! When you check their are alot of Collared Cats Treed ..

WA folks.... Please take the time to respond and send in some comments... I think especially the portion of Possision of Telementry equipment is NOT GOOD for us..
here is my email, I've tried to include good senarios as to real situation that we use telementry "LEAGALY" assuming that just because we have the equipment means we are using it illeagal is completely incorrect!!

Dear commission,
I Strongly Urge you to Hold of on any ruling for this, I think there are many implications that are not thoroughly considered with this ruling.
First I applaud any effort and the concept or Idea of what you are trying. I have no issues making it illegal to use tracking equipment to track wildlife.
However the Portion regarding possession of telemetry equipment while hunting will affect many of Lawful citizens, and Lawful uses, including myself.
Here are a couple quick things to think about how this will affect “lawful” use of recievers.
First, My truck is permanently equipped with Telemetry use for Hunting with Dogs, I use this for the safe return of my dogs while hunting in many different states. My truck is “ALWAYS” equipped with Emergency Food, chains, Sleeping bag and My Tracking equipment, they only time my equipment is out of my truck is when I’m using it or recharging it. At any time, if Any one of my friends loses their dogs or needs assistance, I’m equipped and can assist within a moments notice.
Secondly, Often while Deer,Elk hunting with my Wife or a child, or Father I put one of my Dog tracking collars in their Back pack. That way I can insure if “ANYTHING” happens, I know I will find them very quickly. The piece of mind knowing that I can track them if I need to… Could you imagine how much time and money search and rescue would save if lost hunters, or Hikers had one of these collars or transmitters?? I’m just doing my part to be responsible for mine and my Family’s Safety… I personally think EVERYONE in the woods should have an emergency beacon such as a telemetry transmitter.. My family has a list of all my collars, If something should happen to me, they could track and locate me within hours instead of days.
Another good example of proper use of telemetry, My Father hunts, Twice now I’ve had to take him to the hospital for a heart attack while ELK Hunting. I wouldn’t think of letting him hunt without a transmitter, and you bet I will have my telemetry equipment in my truck at ElK CAMP in the event he does not respond via the radio or needs emergency help… If you have ever listened to your father having a heart attack, and trying speak over the radio to give you directions to his location, It’s not fun. You would greatly understand and appreciate the importance and safety with telemetry..
Avalanche beacons are nothing more than telemetry transmitters, Can we assume that those capable of tracking those with a receiver will be illegal to have in Possession.
HAM Radio operators, many have equipment and Radios that are capable of Receiving telemetry signals. Any HAM radio, operator’s Pickup could be susceptible to this new law.
Again In Closing, I do encourage the idea of making it illegal to track wildlife, However the way this is written, You are taking away a very Safe way for me to keep my family and hunting partners secure. Please consider my comments.
I hate to say that as the rule is written I have to “STRONGLY OPPOSE” If you were to amend and remove the portions regarding Possession of equipment I would support.

I interpret what your quote from the proposal reads, as eliminating two way radios while hunting. Even so, a lot of people use those to keep track of each other too. If they eliminate two way radios then they are definitely promoting raising the risk of people getting lost. Some states don't allow two way radios for the purpose of pursueing game but you can use them to keep track of each other. I have a guide friend that guides in Alaska and he says they carry them strictly to contact each other in case of an emergency. Said they are not allowed to use them for pursueing game.
That's how I interpret it. Bill

I'm pretty sure it's illeagal to use two-way radios in WA to pursue game also..
Yea, I guess that's about right.. I don't support someone tracking down and shooting a collared elk. But I oppose the idea that Just because I have my tracking equipment in my truck while Deer hunting, then I'm automatically assumed illeagal.
It's the same thing, both are capible of doing illeagal acts.. Just because you have the equipment doesn't mean we use it illeagally... that's my point.
What my email was refering to was sticking my Dog's tracking collar in a family members backpack while hunting, or hiking, That way If I even need to locate that person in an emergency, I can just like I do with my Dogs..

Please also spread the word and email people you know asking for them to comment on this..
I've spoken with susan, and Dave (wdfw employee that will present this proposal)?? anyways they are going at this Full bore.
He said that the only reason they have included the Possesion Rule is because of enforcability.
They don't have any hard evidence that people are tracking elk, and deer, only suspect it's happening by way of the number of collard elk killed to non-collared. Again I don't oppose the idea, but I strongly oppose the idea that if we have our hunting gear with us we can't DEER or ELK hunt legally.
Another good point brough up is The Garmin Two way GPS Rhino radios, are those considered radio telementry..They Techincally I think they are a type of telementry? As I read the rule it does not distinguish between frequency, or type of telementry.. Just a Blanket Rule that is not though through...

I live now it wa st an can`t hunt and if could would probably be in jail the first night ! the papers would say transplant papaa redneck from tn. takes a tree limb and whoops-up on dfg agent and county mounty over citation for hunten dogs with tracken colars ! Then all the tree huggen son`s of a gun dressed in black with green-red die in their hair carrying peace not war sighns would be marchen past me and chanting hippy stuff at me and want the cops too put my dogs down cause they chase animals ! When I left tn. my ole buddie Ross Bagwell said : why ya want too go Jack ? I said because I want too be around my son and his fieaunce and their children and he want me there !
