I see that odfw is changing rules on bird nesting . Or I should say clarifying. This is what I copied off their website.


(Allow hunting dog training in game bird nesting habitat year-round as long as wildlife is not harassed)
Does anybody know when this goes into effect.

They passed it last week. You might want to call to see if its in effect.

These revised rules will go into effect on July 1, 2011. At that time any Temporary Game Bird Release Permits for Hunting Dog and Raptor Training will become invalid and persons will need the permit which was approved on Friday.

Basically the new rules that the commission approved will take effect. Technically I think they are already in effect because the commission adopted and they've gone through the steps, but I'm not sure on that so I just figured the July 1st is the safe answer.

Does this mean we need that permit or is that just get bird dogs. I read the revision but I'm a little slow.

I think we can train. We should be able to use the dogs on game that is in season, such as coyotes badgers that sort of thing. Which will help keep Em in shape. If nothin else we can roadem and keep them from diggin out of their kennels. Mine have been doin summer salts in the kennel since birdnesting went into effect.

Jimmy, your right that “harassment of wildlife“ packs more weight. It is an ORS not an OAR. Keep in mind that harassment of wildlife is nothing new, it is unchanged. The reason we have been ticketed for the old “bird nesting” rule is that it is much easier to prove. All the ticketing agent had to do was to see your dog off the leash. There has been a polarized perception by law enforcement on the rule. I have received calls from houndsmen stating that law enforcement in their area never even mentioned the bird nesting rule, as well as from houndesmen stating that they were cited for having their hound on the road. One fella was supposedly given a tongue lashing about the bird nesting rule by an officer while he was fueling up.
You are also correct that you cannot harass wildlife (unprotected animals are excluded from the definition of wildlife). This has always been an OAR.
As for equality, between bird dog trainers and trailing dog trainers I think we get the better deal. Bird dog trainers must obtain a permit depending on the type of bird they are releasing. We don’t need a permit to do training because we don’t use wildlife.

As for “grey area” please be more specific? And please do check for yourself and let us know what you find out.

This is a good thing for us but we could ruin it. We need to be ethical about our training.

Jimmy...I will do my best to clarify and answer questions as best as I can, as long as you don’t start your crap. If you do I will leave you and the rest of the board members to your/their own devises. I did serve on the advisory board and do have intimate knowledge of the new rules.

I thank u don for the time and effort u put into making sure we r heard. This will be a great thing if we don't abuse it.

We are always subject to perception by law enforcement. Law enforcement has the bourdon of proof. It was easy for enforcement to prove the old bird nesting rule so they cited for it. If they thought they could cite for harassment they would have for the stat.

Should we be proactive and go visit our local OPS department and ask for there plans on enforcement?

You pose a good question; How do we prove we are running coyotes? We should be very careful how we answer this on a public forum. We all know these sites get visited regularly by enforcement and anti hunting groups. We may be writing the new standards of enforcement.

They had to delay the permitting for logistical reasons until July 1st.

The permits for the bird dog hunters are free..... I did mention that we pay for our permit/furbearers liscence but really felt that we should build an aliance with the bird dog hunters and not raise a stink. The commission members agreed that we are staying in contact to work on other issues. I feel this is the only way we will stand a chance preserving our culture is by building alliances with other hunting groups.
