SB250 MANDATORY SPAY & CASTRATION BILL

This message was sent to me this morning by our chief lobbyist who's been working continually to get this bill defeated.

This bill was narrowly defeated on the Full Senate Floor!

WE CAN'T LET UP NOW THOUGH!!! The Reconsideration process is a dangerous road to travel!

As I’m sure some of you saw, SB 250 failed yesterday by a 16-15 vote, but was granted reconsideration so it can be taken up for one more vote until Friday. We will continue to work closely with Senator Lois Wolk’s office, as well as the Farm Bureau and CA Cattlemen’s Association, to keep up the opposition to the bill.

Irv, it passed today. Got its 21 votes, now we can only try to stop it at the Assembly and with mr arnold.

Yep, You are correct. I got a call from Mark and he said about an hour or two after the initial vote he garnered enough votes to get it out and passed.
With I might add quite extensive amendments for hunting and cattle/agriculture dogs.

We'll have to wait and see what the final language looks like after the amendments are added.

This still does nothing for Mr. & Mrs. Smith's pet that gets out of the yard because PG&E or a contractor or for any other reason someone leaves the gate open in the yard. I guess they'll get a warning on the first offense. If that's any concilation.

I still think it's a bad bill!!

Irv, I looked at the latest and greatest, it is still the same but they added bird dogs. We do not get exempted from the mandatory spay and neuter. The only thing we get is that if a hunting dog is picked up by animal control while hunting they can't say it was at large. Hey did you see a whopping 19 people have looked at this post...and a quarter of that was you and me...pretty goshdarn (for tender ears) sad.

Irv and Liz I thank you and the others for keeping us up to date on what is going on down there. I know for me I can not drive down and fight with being laid off. But what I do is call every person on the list I dont care if they are for my area or not. I also email them all when the info is posted. I know one thing that might help get more people to stand up and fight is if we could have a letter made up that we can change the wording just a little to each bill we wish to fight. Keep that posted up on here with the letter emails, phone numbers, address and names of the reps we need to contact. Dont know if this could be done or not but might help to get some of the ones that dont have the time to look it up get more involved in our fight.

Have you all asked The U.S. Sportsmen Alliance for their help.
They have helped us here in Virginia from time to time.

Hope you defeat that Bill.

Liz ~ Please note the following below. Being at large is ONE of the criteria for the Sterilization of an animal. If you have a hunting license and your dog is picked up, YOU ARE HUNTING. NO PENALTY.

DON'T GET ME WRONG!!, I still don't like this bill at all! However it is better than it was in the beginning!

I for one appreciate you taming down the F bombs as well, and my ears aren't tender at all. I just see no need for it. Nor do I think that you need to use the Lord's name in vein as you do in your signature.

(f) (1) Any authorized penalty may be imposed upon an
owner or custodian of an unlicensed, unaltered dog for a violation of
this section only if the owner or custodian is concurrently cited
for one or more of the following:
(A) Permitting the subject dog to roam at large.
(B) Failure to provide adequate care for the subject dog in
violation of animal cruelty provisions.
(C) Rabies quarantine violations for the subject dog.
(D) Fighting dog activity in violation of Section 597.5 of the
Penal Code.
(E) Failure to comply with the local jurisdiction's requirements
for the keeping of a dog that has been adjudicated by a court or an
agency of appropriate jurisdiction to be potentially dangerous,
dangerous, or vicious.
(F) Failure to possess an unaltered dog license.
(2) Any owner or custodian of an unaltered dog who is found to be
subject to a penalty under paragraph (1) shall be required to
surgically sterilize the unaltered animal in accordance with this
section. The licensing agency shall utilize its existing
procedures may utilize procedures as they exist on the
effective date of this Section for any appeal of this
requirement.
(3) Any owner or custodian of an unaltered dog who is lawfully
using that dog for the pursuit or take taking
of mammals pursuant to Section 265 of Title 14 of the
California Code of Regulations or for the lawful pursuit or
taking of migratory game birds, game birds, ducks, and other
permitted water fowl and has lawfully purchased a hunting
license as provided in Section 3031 of the Fish and Game Code shall not be in violation of
subparagraph (A) of paragraph (1).

Catkidd ~ It just passed by a partisan vote 6-3 out of the Assembly Business & Professions committee Tuesday.

I do believe our next shot is the Assembly Appropriations Committee. I'll find out more in a day or so.
I'll keep everyone posted, man!

Folks WE NEED TO CALL , FAX, WRITE, and Email these folks right now!! TELL THEM YOU OPPOSE SB 250!! ASK FOR THE GOOD ASSEMBLY MEMBER TO DO THE SAME!!
I just finished contacting the entire list of 16. You can do it in 15 minutes or so.

They said that they've been getting some calls and faxes from the entire NATION!
THIS IS GOOD!
AS YOU KNOW, WHAT STARTS HERE JUST SNOWBALLS AND GETS BIGGER AND WORSE AS IT HEADS EAST!!
They told me that it's about 50/50 on the calls, but A LOT MORE IN OPPOSITION AS THE FAXES GO!
LET'S BURN UP SOME MORE FAX MACHINES AS WE DID LAST YEAR ON AB1634!

How much easier could I have made it for you, or anyone else? You have each individual Assembly Member listed that are on the Appropriations Committee along with their individual contact information.

I don't know what else I could do.

PLEASE CROSSPOST WIDELY

A contact on the Appropriations Committee has just told us that, until today, calls in opposition to SB250 have outnumbered the ones in support but that dramatically turned around today. Mancuso's minions are flooding the committee members with calls and faxes. We MUST do the same! Please get everyone you know to call and fax.

And, if you possibly can, come to the Capitol, Room 4202, for the hearing at 9 am Wednesday morning.
