Prop 109... Good or Bad?

I am a little confused on this Prop 109 stuff. I believe I either ditched or slept through any class that would make this stuff easier to understand, unless everyone is like me and you CAN'T understand it completely and just hope you checked the right box on the ballot.

When I read this is saw that it would make hunting, fishing, and harvesting wildlife a constitutional right... Then I read it would allow congress and such to make new laws, remove laws, or enforce them harder... WTF!?

So, what do I do in order to allow hunting to be legal and not have congress vote it all out and the only hunting we do is on Cabelas Biggame Hunter???

It's a double edged sword to some degree. I love to hunt and fish. I do it nearly all the time and of course I want those activities to be available to my children and theirs.

From what I understand it is not congress but the state legislature that would be given the "power" to change the laws. Also from what I understand they all ready have the "power" but have delegated that power to the AZGFD. I read that if it passes they will continue to have the AZGFD manage the wildlife in the state, so nothing would change that I have noticed.

There was an attempt at this a few years back that the AZGFD did not support, but this one they do support.

Here's the tricky part though. Supporters of Prop 109 want it passed to prevent groups like PETA and/or HSUS from coming here and trying to shut down lion or bear hunting. Or lion hunting south of the I-10 to help save the jaguar. That's all good, but the citizens in the states voted to ban lion/bear hunting are the ones who are at fault. In my opinion, this law protects us from stupid uneducated or lazy people from voting with their emotions instead of doing the research and looking at the facts. If the citizens in those states that voted yes to banning certain practices looked at all of the facts, I am sure many would have changed their minds and voted against it.

And that really goes for just about any issue or office. Screw political parties, look at the actions; They speak louder than words, but a lot of people use their emotions instead of logic when voting.

Also, I believe the Prop should have included all outdoor activities and could have been written very simply like, "The right of the citizens to partake in any/all outdoor activities including but not limited to: hunting, fishing, atv riding, sky diving, hiking, bird watching, etc. shall never be taken away. All citizens are allowed to enjoy such activities so long as they do not overtly or intentionally violate someone else's right to do what ever the hell they want outdoors or indoors!"

Should you vote yes or no, hell I don't know. The state legislature here kinda sucks. They can't write a descent damn law, see SB 1070 and this Prop 109. Also, what happens in the future? We could keep on getting fruits and nuts from California and wind up with a democratic, tree hugging state legislature. Then who knows what would happen to our game and fish laws. I say keep it out of the state's hand, but you have to be vigilant and do your part should any group come here and try to ban ANY type of outdoor/indoor recreation. United we stand, divided we fall.

Havnt read it but in theory sounds ok. Its one of those things that look good on paper but the reality might not be good. If it gets passed into law that would mean all the habitual poachers who have had there hunting rights taken away in Az or other states wouls all be allowed to hunt in AZ. Not sure if those are the folks you want in your woods. The other kicker is FEDERAL LAW always superceeds state law. So if it did pass and the feds decided to stop all lion hunting in the Jag areas(public land) they still could no matter what the state law.

So not sure if it would be good or bad but sounds like it would be a good step forward in preserving hunting hertitage in AZ

therein lies one of the major problems we have in this country, the fact that federal law supercedes state law. We need a revival of states rights and tell the feds, who by the way, are not interested in solutions, to but out. Who knows the needs of a community better than that community itself? The feds are more interested in political power than solutions. That is part of the reason Arizona has the immigration problem. Let those on the ground level take care of it. Nobody but the citizens of Arizona should determine the status of hunting rights in their state. Oh well, enough of that.
