boss hogg ask for case law and code my attorney is intrested since he cant find where they come up with these statements be sure to tell them you will be talking to an attorney about this so called power that no one else has

I think Bear Hunter is on to something with the "Highly Regulated" point. I have had Game Wardens say that to me before. They still need probable cause. A hunch is not probable cause. They do not have to be honest about what they can legally do. They are not your attorney. It is legal for law enforcement to say they have the right even if they legally don't. So ask a game warden all you want, probably not the most dependable source.

The fact that hunting and fishing is highly regulated does not give them the right to stomp on the constitution. They can not just search your truck. That is why they ask for permission.

What it comes down to with me is respect. If they treat me decent then I may let them search. If they want to be jerks I will be one too. They have a tough job and I wouldn't want to do it. But freaks like Boyd have no business looking in my truck.

I haven't heard any one make fun of him for barking like a dog when he heard those hounds. What a nitwit. :lol: :lol:

If you could ask them about when they ask you for permission to search your truck and you say no does this give them probable cause? I have been told by some that it does.

Being a retired cop I can answer that one for you Chris. No it doesnt give thm probable cause. Basically you in the woods hunting is all the probable cause they need to search you or your vehicle. They do have that ability. Also because of court rulings when you are in the woods hunting they are operating more under "Reasonable Suspicion" than Probable Cause. The differance is "Reasonable Suspicion" Would be the hearing a gunshot and seeing you leave the area. "Probable Cause" would be seeing blood in your vehicle, a loaded gun, etc. As a cop I could not search a car under "reasonable suspicion" but could with Probable Cause. The courts have said that because a vehicle is Mobile there is a greater urgency for a search because of the ease of destroying evidence or leaving the scene. They can also go onto any private land where they KNOW hunting is immediatly occurring and they KNOW wild animals are on the property. They cannot just come into your house but the courts have given them the authority to enter your land.
Whats sad is this conversation would not be necessary if the Wardens treated us with respect instead of automatic criminals. Noone would question a warden who was legitimately doing his job. I will try and find a copy of the Kline Report to post. They use it in the academy for training. Basically it states that all houndhunters are poachers and involved in the illegal trade of bear gall bladders in some form. Trust me when I say this wardens are not your friends. Even when they are acting nice to you its just a game. They do not like hound hunters. Be courtious and respectful to them but hold them accountable for their actions. I am sure that somewere out there a few good ones exist. They are like exceptional hounds though. Few and far between.

bear hunter having run the guantlet with fish and game and the court system i've learned a few things law enforcement can and will lie to make a case not saying you did but it did happen to me ; funny part was when we got to court the judge had a diffrent opinion as to what they could and couldnt say and do and it wasnt at all like your saying i gave up no rights when i signed my hunting liscence ,in my vehicle yuo must have a warrent on my property he can come on if he suspects ive broken a law now is when it got sticky if he found nothing now he's in violation of trespassing because he didnt have my permisson . now i understand you are a retired cop and all the cops around here said the same thing you did but now i challange all of them everytime . there is a document called the constition we have rights learn them . the howl boyd let out on the mountain was the fish and game mating call if you hear it your about to get scrd

I may have found some good news. Check out my post "Wardens may have lost their search rights". I am a law abiding hunter and have no problem with warden just doing their job. Brian Boyd made it personal when he filmed that documentory. Each and every houndsmen should be offended by it and ready to call Fish and Game on it.

I watched the show a couple days ago and I’ve been trying to compose a good way to word my post. But I just can’t think of a good way to say it. You guys sure have some crack pot wardens out there. Maybe we have guys like that around here too and I just don’t know it. I sure hope they are playing it up for the cameras. They should be embossed by how buffoonish they look on TV. I’m sure there are viewers that will eat up the hype and drama. Hopefully viewers will have enough of a brain to realize that Boyd is a nut job and needs therapy. I get that you need a passion, drive and desire to do a job like that. Normally I commend a guy that is willing to put in that much effort for a job like that. I just don’t like the mentality that people are “guilty until proven guilty and still guilty even if it can’t be proven” attitude.

I watched the show and there are alot of ways you can look at it. The hunters were legal and were being harassed. On the other hand we all know a hunter has no legitimate use of a gal bladder in a bag and they lied about why they had it. I have a couple of buddies I grew up with who became wardens and it is an extremely difficult job especially for the money they make. On the other hand I do believe some abuse thier power and work against hunters instead of with them. I know California and the National Game and Fish is very much anti hunting. The show was very one sided and hunters come out looking bad.

i dont think its the department of fish and game thats agenst hunting i think its just a few of their officers on power trips because if they ban hunting they will be out of a job :lol: . just for an example last year they sold 24,805 bear tags @ $41.86 each for a grand total of $1,038,337.30 and thats just in bear tags ! if they were to ban hound hunting they will lose bobcat tag and lots of license revinue too. i dont think their willing to take that kind of pay cut just to please some antis.

Just watched this weeks episode. No Houndsmen. I actually liked watching it, they focused more on busting spotlighters and deer poachers.

Swear i read somewhere that Nancy Foley the chief law enforcement officer for dfg has taken money and has made clear that she will continue to work with HSUS "We are again very grateful to The Humane Society of the United States for their support of the wardens' efforts to combat the increase in poaching. We look forward to continued collaboration on this issue." kinda makes you wonder if stopping poaching is there main objective. my question is why would our fish and game department deal with any anti hunting groups Especially one as radical as HSUS.

I justed watched the episode where they bust all the pot farms. what a joke! I think if i ever had a run in with a cocky little barney five warden smart ass like the one on that episode, he might come up missing!
"Houndn'Ems Blueticks" if it smells like a cat, they'll catch it.
