PLEASE READ NEED HELP GETTING MY DOG BACK ASAP
Went coon hunting on Monday and the rain set in on me. I was able to track the dogs but could not hear them. They got up in the bay in the club that i am in and started to head for a secondary road off of a main road. I caught 2 of the 3 dogs and the 3rd dog got across the highway without me knowing. I went back in the club and couldn't even track the dog. I think a man picked him up and took him to his place. I Road all in the club and could not get a track with my ATS system. Went on Tuesday and tried tracking all day and finally got a track 5:00 that evening, Had the dog pinpointed around 7 or 8. Didn't leave from tracking him off the main road till around 11 on Tuesday night to make sure he was going to bead down for the night. Couldn't get to the dog for 2 big creeks. The only way to get to him i thought was by a boat. Went back the next morning and was tracking the dog just down a little from were i left him. Figures out were a road was that would take me close to the dog.I got Permission from a man that lives down this like 2or 3 mile dead end dirt road. which is neighbors with a man that boards horses.The dog was to a the horse mans place, that by the way is known for taking tracking collars off dogs and beating the collar to pieces or turning them off.(He has a dog of another hunters for 2 year now and the law wouldn't do anything about it). When I got down the this morning my dog was tracking towards the mans house that has the horses and takes the collars off the dogs. I was getting a good signal with my attenuator on and the gain turned down. I started hollering the dog to me, Then several dogs start barking some of which were hound dogs. The horse man fires several shots from a gun and then my signal dropped(dog headed away from me), and then started heading back to the right, towards a stable. I got back to the road and was tracking the collar right to the stable, as i was in the middle of tracking and hollering for the dog the signal just dropped out. NO signal whatsoever. The dog was tracking only a couple 100 yards. After the signal cut off a man walks out of the stable. I called the sheriffs office and about an hour later they had a guy out there. He talk with the man and he said he hasn't seen a dog and if he did he would certainly give me a call. Sheriff wouldn't do anything. Called the game warden and they wouldn't do anything to really help.So i went to the magistrates office and they said that all i told them was speculation and the only way they could do anything is if i found my collar. They wont give me permission to look for the collar,and that is the last place I tracked the collar. If i had it i wouldn't have anything to worry about just as long as it was on the dog. The horse man will not even stop and talk to me i Have tried flagging him down several time and he speeds up when i would try to talk to him. People has had him pull a gun on them for trying to get there dogs. the Man Is CRAZY.
Let me know your input please and what my rights are. I live in Carteret county in NC but the dog is on Craven county land.

the man can not keep you from your dog in the state of nc and the sheriff and warden have to make him let you look for your dog and collar. considering thats the last place you tracked state law says removal of a tracking collar is a 1500 dollar fine and you have the right o look on his property with a sheriff escort because probable cause is enough to search your car so last place you tracked is probable cause too. if you want to get nasty call the lawyer rusty mclean. he'll have them crying in the court room.

I wouldnt have yelled letting him know you've sourced his place as being where the dog might be.
I'd go the lawyer route as well otherwards, considering I cant post how I would deal with this... spend some time glassing from the distance from different angles and try and get a visual on your dog to further support your case for legal assistance to recover your dog.
Better yet, hire a plane and buzz his property several times.
Guaranteed it is tied up til he gets used to his new "home."

name is russel mcclean III. best wildlife lawyer in the state. they'll know his name in your part of the world too. i personnally saw him make a federal agent cry in court twice in one day. but your rights give you the ability to retrieve your property. take the dogs papers and a recent picture to the law with your state wildlife rule book with the tracking collar rule highlighted and state you were tracking your dog at his barn and he fired shots and you will not file charges for attempted murder(since he fired a weapon) in exchange for the ability to search for your dog. also take the other guy that lost his dog there and throw a double whammy on them.
